AirHorizon is not aviation-certified and must not be used as a primary flight, navigation, or other safety-critical instrument.
Overview and Acceptance
These Terms of Service ("Terms") govern your use of the AirHorizon iOS and iPadOS application and any related content, features, upgrades, and services made available through the application (collectively, the "App"). The App is provided by Valerii Nikolaev ("we," "us," "our," or the "developer").
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Eligibility and User Responsibility
You represent that you are legally permitted to use the App in your jurisdiction and that you will use the App only in compliance with applicable laws, regulations, and operating procedures.
You are solely responsible for:
- your use of the App;
- any decisions, actions, or omissions made in reliance on the App;
- compliance with aviation, transportation, safety, and operational rules applicable to you;
- maintaining any certified, legally required, or operationally required instruments, devices, procedures, and backups.
Service Description
AirHorizon is a utility application that may provide, among other things:
- on-device visual horizon, pitch, roll, and heading-related display features;
- speed and altitude display features, including GPS/GNSS-derived and barometric altitude where available;
- device motion, orientation, heading, pressure, and location-assisted reference features;
- optional external telemetry features that may receive user-configured simulator or local-network data;
- calibration and display customization tools;
- optional premium features made available through auto-renewable subscriptions or one-time purchases, where offered.
The App and any feature, content, product offering, or availability may change, be limited, suspended, or discontinued at any time, with or without notice.
Critical Safety Notice
The app is not aviation-certified, safety-certified, fail-safe, or mission-critical software.
The app is not a certified flight instrument, attitude indicator, standby instrument, heading indicator, navigation device, or operational avionics equipment.
The app is provided only as a supplemental, convenience, informational, and reference tool. It is not intended to replace, and must not be used as a substitute for, certified instruments, approved avionics, required safety equipment, official navigation data, or professional judgment.
You must not rely on the app as a primary basis for flight, taxi, takeoff, landing, IFR, VFR, navigation, terrain clearance, separation, attitude recovery, emergency response, or any other safety-critical or time-critical decision.
If you choose to use the App in or around an aircraft, vehicle, vessel, simulator, machinery environment, or any other setting involving risk of injury, death, property damage, or environmental damage, you do so entirely at your own risk.
Sensor, Heading, Location, and Calibration Limitations
The App depends on consumer hardware, operating-system services, and device sensors and system services, which may include the accelerometer, gyroscope, device-motion processing, compass or heading services, location services, barometric or pressure sensors, and user-configured external telemetry sources. These inputs may be unavailable, interrupted, degraded, delayed, drifting, noisy, misaligned, or inaccurate for many reasons, including:
- sensor limitations or hardware faults;
- magnetic interference;
- signal obstruction or degraded location conditions;
- calibration errors or lack of calibration;
- device orientation, mounting position, vibration, movement, or temperature;
- battery conditions, low power mode, or operating-system behavior;
- software bugs, unsupported devices, third-party service issues, or connectivity issues.
Any visual horizon, pitch, roll, heading, north reference, altitude, speed, flight-director cue, or other output generated by the App may therefore be wrong, incomplete, stale, unstable, unavailable, or misleading.
Altitude, speed, barometric pressure, GPS/GNSS, and external telemetry data may be unavailable, delayed, stale, drifting, approximate, or inaccurate. Barometric altitude may vary due to pressure changes, weather, device limitations, calibration, and operating-system behavior.
You are solely responsible for verifying the accuracy, suitability, calibration status, and fitness of any App output before and during any use. The developer does not guarantee that any displayed value or visual representation corresponds to actual aircraft attitude, heading, orientation, position, or safe operating conditions.
No Professional, Aviation, Navigation, or Safety Advice
The App does not provide aviation advice, flight instruction, navigation advice, airworthiness advice, safety assurance, dispatch approval, regulatory compliance advice, legal advice, engineering advice, or any other professional advice.
Any information or output presented by the App is for general informational purposes only. You remain solely responsible for all operational and safety decisions.
Subscriptions, Trials, Billing, Purchases, and Refunds
Certain App features may require a paid entitlement, including an auto-renewable subscription or a one-time in-app purchase, if and when offered.
Where applicable:
- payment is charged by Apple to your Apple ID account;
- subscription renewal, billing cadence, pricing, taxes, trials, and transaction handling are managed by Apple under Apple's terms and policies;
- subscriptions renew automatically unless cancelled in accordance with Apple's rules;
- you can manage or cancel subscriptions in your Apple account settings;
- refund requests must be submitted through Apple, and Apple determines refund eligibility;
- any purchase, entitlement, or subscription status shown inside the App is provided for convenience only and may be delayed, incomplete, or temporarily incorrect.
We do not control Apple's billing systems and are not responsible for billing errors, renewal failures, payment processing issues, App Store outages, regional pricing differences, tax handling, or refund decisions made by Apple.
Third-Party Services and Platform Dependencies
References to third-party simulators, products, or services are for setup, compatibility, or informational guidance only and do not imply affiliation, endorsement, certification, support, sponsorship, or approval by those third parties.
Assumption of Risk and Release
You knowingly and voluntarily assume all risks arising from or related to your installation, access, or use of the app.
To the maximum extent permitted by law, you release, waive, and discharge the developer from claims, demands, causes of action, damages, losses, costs, and expenses arising out of or related to your use of the app in any aircraft, vehicle, vessel, simulator, or other potentially hazardous context.
This includes claims based on sensor error, display error, heading error, location error, calibration error, delay, interruption, unavailability, user misjudgment, third-party failure, or reliance on app outputs.
Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the developer from and against any claims, actions, demands, proceedings, liabilities, damages, judgments, settlements, penalties, fines, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your use or misuse of the App, your breach of these Terms, your violation of law, regulation, or third-party rights, your use of the App in any aircraft, vehicle, vessel, simulator, or other hazardous or regulated environment, or any injury, death, property damage, operational event, or regulatory matter connected to your use of the App.
Changes to Terms
We may revise these Terms from time to time. Updated Terms may be posted within the App, on a website, or otherwise made available to users. Your continued use of the App after updated Terms are made available constitutes your acceptance of the updated Terms.
Severability and Waiver
If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
