Terms of Service for Handstand Balance

Overview and Acceptance

These Terms of Service ("Terms") govern your use of the Handstand Balance iOS application and any related content, features, upgrades, and services made available through it (collectively, the "App"). The App is provided by Valerii Nikolaev ("we," "us," "our," or the "developer").

By downloading, installing, accessing, purchasing through, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Eligibility and Supervision

You represent that you may legally use the App in your jurisdiction. If you are not old enough to enter into these Terms independently, you may use the App only with permission from a parent or legal guardian. Minors must be appropriately supervised during physical activity.

Service Description

Handstand Balance is a fitness practice utility that may provide:

• live, camera-based body-pose detection and simple form cues;
• automatic estimates of valid handstand hold time;
• workout recording, optional pose and timer overlays, app-generated coaching audio, saving to Photos, and sharing;
• on-device analysis and replay of a video you select;
• local attempt history, progress metrics, charts, and export;
• spoken coaching and counting;
• free and paid Handstand Balance Pro features.

Features, content, device compatibility, and availability may change, be limited, suspended, or discontinued as the App evolves or as required by law or platform rules.

Exercise and Safety Notice

Handstands and other inverted exercise involve an inherent risk of falling, collision, head, neck, spine, shoulder, wrist, or other injury, property damage, and, in severe cases, permanent disability or death.

The App cannot see every hazard, catch you, prevent a fall, evaluate your medical condition, or guarantee safe form. Never rely on the App as a spotter, emergency service, or safety system.

You are solely responsible for:

• deciding whether you are physically and medically able to practice;
• using an appropriate surface, sufficient clear space, and qualified supervision or a spotter when needed;
• keeping people, pets, furniture, sharp objects, glass, and other hazards away from the practice area;
• placing and securing your device where it will not create a trip, impact, or fall hazard;
• using safe progressions and stopping before fatigue or loss of control makes practice unsafe;
• following applicable laws, facility rules, and professional advice.

Stop immediately if you experience pain, dizziness, faintness, chest pain, shortness of breath, numbness, unusual weakness, loss of balance, or any other concerning symptom. Seek appropriate medical attention. If you have an injury, health condition, pregnancy, mobility limitation, or any reason to question whether inverted exercise is appropriate, consult a qualified healthcare professional before using the App for exercise.

Detection, Coaching, Timer, and Video Limitations

The App uses consumer-device cameras, Apple's Vision and media frameworks, heuristic pose rules, timers, and speech services. Results can be inaccurate, incomplete, delayed, unstable, or unavailable because of lighting, framing, camera angle, distance, occlusion, clothing, multiple people, motion blur, device movement, hardware limits, operating-system behavior, software bugs, or other conditions.

A detected pose, hold time, form cue, progress value, replay interval, skeleton overlay, or stated reason that a hold ended is only an automated training estimate. It is not official judging, biomechanical analysis, injury screening, or a professional assessment. The use of words such as "coach," "coaching," or "form" describes App features and does not mean that a human coach or licensed professional is evaluating you.

You must independently verify whether the App's output is suitable for your use. Do not continue an attempt, change technique, or take a safety risk solely because the App displays or speaks a cue.

No Medical or Professional Advice

The App does not provide medical advice, diagnosis, treatment, rehabilitation, physical therapy, injury prevention, emergency assistance, professional gymnastics instruction, personal training, or other professional services. App information is provided only for general fitness practice, convenience, and informational purposes.

Camera, Photos, Recordings, and Other People

You control when to start a session, import a video, create a recording, save to Photos, export progress, or share content. You are responsible for obtaining any permission required before recording, analyzing, storing, or sharing images or video of another person, including a minor. Do not use the App to invade privacy or violate publicity, copyright, facility, or other rights.

The current App does not record microphone or ambient room audio. App-generated spoken coaching may be included in a workout recording. You are responsible for reviewing any recording before sharing it and for the services and recipients you choose through the system share sheet.

Your Content

As between you and the developer, you retain your rights in videos and progress files you import, create, or export. You grant the App a limited permission to access, copy, transform, analyze, display, save, and prepare that content on your device only as needed to provide the features you request.

You represent that you have the rights and permissions needed to use content with the App. The developer does not take responsibility for content you record, import, save, export, or share.

License and Acceptable Use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for lawful personal use on Apple-branded devices that you own or control, as permitted by applicable App Store rules.

You agree not to:

• use the App unlawfully, recklessly, unsafely, or in violation of another person's rights;
• rely on the App as a guaranteed coaching, timing, judging, medical, or safety system;
• copy, reverse engineer, decompile, disassemble, modify, or create derivative works from the App except where applicable law expressly permits it;
• interfere with the App's integrity, security, performance, purchase controls, or availability;
• attempt unauthorized access to systems, data, or services related to the App.

Purchases, Subscriptions, and Paid Features

The App may offer Handstand Balance Pro through auto-renewable monthly and yearly subscriptions and a one-time lifetime purchase, subject to availability in your region and App version. The purchase sheet displays the current price, billing period, taxes, trial or introductory offer (if any), and other transaction terms before you confirm a purchase.

Apple processes all purchases. Monthly and yearly subscriptions automatically renew for another billing period unless canceled through your Apple Account within the time stated by Apple. Apple controls billing, renewal, cancellation, refund, family-sharing, and payment-dispute processes. Deleting the App does not cancel an active subscription.

A lifetime purchase, if offered, is a non-renewing purchase that provides access to the applicable Pro features for the supported life of the App as made available by the developer. It does not guarantee that the App, every feature, or compatibility with future devices and operating systems will exist indefinitely. Access remains subject to refunds, revocations, these Terms, technical limitations, platform rules, and lawful product changes.

Paid access is subject to information supplied by Apple. Use Restore Purchases where available if an eligible purchase is not recognized.

Apple Terms and Third-Party Services

Your use of the App is also subject to the applicable App Store terms and Apple's Standard Licensed Application End User License Agreement unless another end-user license agreement is presented through the App Store. These Terms supplement applicable platform terms. Mandatory platform terms and non-waivable law control if a provision conflicts.

The App depends on Apple services and operating-system components, including Camera, Photos, iCloud Photos where enabled, Vision, AVFoundation, speech, StoreKit, and the system share sheet. Those services may be unavailable, interrupted, changed, or governed by separate terms and privacy practices outside the developer's control.

Intellectual Property

The App's original software, design, text, branding, and other developer-created materials, and the related intellectual-property rights, are owned by or licensed to the developer. Apple and other third-party materials remain the property of their respective owners. These Terms do not transfer ownership to you. All rights not expressly granted are reserved.

Updates, Availability, and Termination

We may update, modify, limit, suspend, or discontinue some or all of the App, or stop supporting a device or operating-system version. We do not guarantee uninterrupted availability, backward compatibility, preservation of local data, or correction of every defect.

We may restrict or terminate access where reasonably necessary for security, abuse prevention, legal compliance, platform requirements, technical issues, or material breach of these Terms. Provisions that by their nature should survive termination will survive.

Disclaimer of Warranties

To the maximum extent permitted by law, the App and all detection results, timing values, cues, recordings, overlays, progress data, and related features are provided "as is," "as available," and "with all faults."

To the maximum extent permitted by law, we disclaim all express, implied, statutory, and other warranties and conditions, including merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, compatibility, security, and non-interruption.

We do not warrant that the App will recognize a handstand, measure time correctly, identify a form issue, preserve a recording or progress entry, work in every environment, or be suitable or safe for your particular training needs.

Assumption of Risk

You knowingly and voluntarily assume the risks associated with handstand practice, inverted exercise, recording your activity, and relying on automated App output.

To the maximum extent permitted by law, you are responsible for injury, loss, damage, or claims arising from your physical activity, practice environment, device placement, content, sharing, choices, or misuse of the App.

Limitation of Liability

To the maximum extent permitted by law, the developer will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, use, or business opportunity, arising from or related to the App or these Terms.

To the maximum extent permitted by law, the developer will not be liable for injury, death, property damage, privacy claims, lost recordings or progress, detection or timer errors, coaching errors, device or operating-system failure, third-party service failure, or your reliance on the App.

To the maximum extent permitted by law, the developer's total aggregate liability for all claims related to the App or these Terms will not exceed the amount you paid for the App's paid features during the twelve months before the event giving rise to the claim, or the minimum amount required by applicable law if greater. Some jurisdictions do not allow certain exclusions or limitations, so some of this section may not apply to you.

Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless the developer from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful or improper use of the App, your content, your breach of these Terms, your violation of another person's rights, or your physical activity. This obligation does not apply where prohibited by law.

Changes to These Terms

We may update these Terms when the App or applicable requirements change. We will post the revised version and update the date above. Your continued use after revised Terms become effective means you accept them, except where applicable law requires a different form of notice or consent.

Governing Law and Consumer Rights

These Terms and disputes relating to them are subject to applicable law, including mandatory consumer-protection rules in your place of residence. Nothing in these Terms limits rights or remedies that cannot lawfully be waived or prevents a claim in a forum required by applicable law.

Severability and Waiver

If a provision is held unlawful, invalid, or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver of that or any other provision.
